These Terms of Use ("Terms") apply to your use of WagadProperties.com and its related services (the "Platform"), operated by Udaipur Ride, 2nd Floor, 32F, Sub City Center, Sector 8, Near Reti Stand, Udaipur, Rajasthan 313001, India ("WagadProperties", "we", "us"). By using the Platform you agree to these Terms. If you do not agree, please do not use the Platform.
1. What the Platform is
WagadProperties is an online marketplace where owners, brokers and our field agents list properties for rent, sale or girvi (mortgage) in Udaipur, and tenants and buyers can find them and contact the person who listed them. We are not a party to any rent, sale or girvi agreement between users. Any deal, payment, agreement or handover is only between the users involved.
2. Eligibility and account
- You must be at least 18 years old to create an account or post a listing.
- You log in with your mobile number and a one-time password (OTP) sent on WhatsApp or SMS. Keep your phone safe; you are responsible for activity on your account.
- Give correct details (name, mobile number, role as owner, broker or tenant). We may suspend accounts that use false details.
3. Listing a property
- Listing a property is currently free.
- You may list only a property that you own, or that you are authorised by the owner to rent out or sell. Brokers must say that they are brokers.
- Price, deposit, size, photos, location and availability must be true and up to date. Mark the property as rented out or sold as soon as it is no longer available.
- Photos must be of the actual property. Do not upload photos of other properties, photos taken from other websites, or photos showing people without their consent.
- By posting, you allow us to show your listing, photos and the details you share on the Platform, in search engines and in our promotions, and to edit the format (for example cropping photos or adding room labels).
- We may review, edit, hide or remove any listing at any time, for example if it is a duplicate, wrong, unavailable or breaks these Terms.
4. Verification by field agents
Some listings are visited and checked by our field agents. A "Verified" badge means that on the date shown, our agent visited the property and found that it matched the listing in the points checked. It is not a guarantee of ownership, legal title, building approvals, condition or the conduct of the owner. Before you pay any money or sign any agreement, check the property and documents yourself.
5. For tenants and buyers
- We do not charge tenants any brokerage. If a broker has listed a property, any fee is between you and the broker; the listing shows when it is posted by a broker.
- Visit the property before paying anything. Never pay a "token amount" or deposit to someone you have not met or for a property you have not seen.
- Check the owner's identity and documents and make a written rent agreement.
6. Chat, calls and visits
- Use chat and contact details only to talk about the listing. Do not send spam, abusive, threatening or obscene messages.
- Do not ask for, or share, OTPs, bank passwords or card details in chat.
- For your safety and to stop fraud, messages are stored on our servers and may be reviewed by our team when a user reports a problem or when we see signs of misuse.
- You can report or block a user. We may suspend users who are reported for misuse.
7. Things you must not do
- Post fake, misleading or duplicate listings, or a property you have no right to list.
- Pretend to be someone else, or pretend to be from WagadProperties.
- Collect other users' contact details for marketing, or copy listings or data from the Platform using bots or scrapers.
- Discriminate against anyone on the basis of religion, caste, gender, or similar grounds in a way that is unlawful.
- Upload viruses, try to break into the Platform, or interfere with how it works.
- Use the Platform for anything illegal.
8. Fees
Using the Platform and listing a property is free at present. If we start any paid service in future, its price and terms will be shown clearly before you pay. See our Refund & Cancellation Policy.
9. Content and intellectual property
The Platform's design, logo, text, area guides and software belong to WagadProperties. You keep the rights in the photos and text you post, and you give us the permission described in section 3. Do not copy our content without written permission.
10. Disclaimer and limit of liability
The Platform is provided "as is". We try to keep information correct, but we do not guarantee that every listing, price or area guide is complete, correct or current. To the extent allowed by law, WagadProperties is not liable for any loss arising from a deal between users, from information posted by users, or from your use of the Platform. Our total liability for any claim will not be more than the amount you paid us, if any, in the 12 months before the claim.
11. Suspension
We may suspend or close an account, or remove content, if we believe these Terms or the law have been broken. You can stop using the Platform and ask us to delete your account at any time by writing to support@wagadproperties.com.
12. Changes to these Terms
We may update these Terms. The date at the top shows the latest version. If you keep using the Platform after a change, you accept the updated Terms.
13. Law and disputes
These Terms are governed by the laws of India. Courts at Udaipur, Rajasthan will have exclusive jurisdiction.
14. Grievances and contact
For complaints about content or a user, contact our Grievance Officer: Rajkumar, 2nd Floor, 32F, Sub City Center, Sector 8, Near Reti Stand, Udaipur, Rajasthan 313001, India, email support@wagadproperties.com. We acknowledge complaints within 24 hours and aim to resolve them within 15 days.
